在以下条款和条件当中“工作室”指代Studio-frae ehf.浮来工作室;“摄影师”指代Studio-frae ehf.浮来工作室的摄影师;“客户”指代预定表中填写的客户。双方同意,以下协议条款构成本合同的组成部分,客户不得以任何方式更改,除非摄影师以书面形式明确同意这些条件。

 

第一条 预定条款

1. 预订费

预订时,客户需在将预定金或和其他附加服务放入购物车后24小时内支付以确保预订的成功,如24小时内客户没有结账工作室将会在网站上取消订单并重新开放对外预定。

2. 余款支付

客户在预定前应获知自己即将预定的服务的全款,所有预定明细将在预定产生时列在订单上,由工作室发出一份正式的邮件说明。全款减去预定金所剩余的余款需在拍摄开始前结清。如之后产生其它道具或服务将由客户在结尾款时一并结清,例如骑马,租船,化妆等。

2. 付款方式

本网站预订金付款方式可以采用信用卡或其它手动网络支付方式:微信,支付宝等。若客户在第三方平台预定则由第三方平台收取。

 

第二条 许可,服务范围和修片

1. 服务/活动期间拍摄的照片将由摄影师自行决定,但会尽一切努力符合客户的要求。

2. 工作室应被授予有关选择所使用的位置和姿势的创造性和艺术性许可。摄影师出于艺术修养指导选择拍摄姿势和拍摄地点和角度,客户应在确认自身安全的情况下听从摄影师的指挥并以摄影师的眼光为准。

3. 客户应认可对照片风格和拍摄照片数量的判断。由于天气,光线,被拍者的个性和意愿,有些照片可能不合适。 工作室将尽最大努力兑现客户所要求的照片,但不承诺保证任何具体的图片,也不包括任何具体的背景,位置或姿势安排。

4. 当拍摄时,摄影师应尽量按客户要求的时间点拍摄所有人,但摄影师应不承担有人离席的责任。

5. 在特定的地点,当拍摄活动收到官方限制导致拍摄计划无法顺利完成时,摄影师不应承担责任。

6. 当拍摄活动由于客户的个人原因导致拍摄计划无法顺利完成时,摄影师不应承担责任。

7. 由于各种不受控制的照明条件和传感器设备会导致部分照片出现色差。

8. 摄影师会不定期检查设备并采取合理的措施确保备用设备可用,但摄影师不应承担由于意外事故,包括而不限于设备在拍摄过程中被损毁等原因,而不能生产照片所发生的损失。

 

第三条 交付及格式

1. 工作室订单中提及的原片JPG是指摄影师在当天/次拍摄过程中相机直接生成的未经修改过的JPG格式的文件。

2. 工作室订单中提及的修片是指工作室在与客户的沟通后针对部分照片进行再加工后的JPG格式文件。

3. 工作室将会通过分享网络链接的形式来发给客户照片电子文件,客户需在30天内下载转存这些文件。若30天后链接失效导致文件消失,工作室将不负责。

4. 客户可以向工作室购买订单以外的修片,价格参照工作室的报价表。

5. 工作室不向客户提供JPG以外格式的文件。

 

第四条 版权与所有权

1. 除非在预订时和摄影师另行协商,根据1998版权,设计和专利法赋予浮来工作室版权。通过以打印或数字方式购买图像,客户购买的是使用图像的权利,而不是版权,因此没有权利在任何介质上修改或抄袭图像。客户不得出于商业目的修改或抄袭在此合同下拍摄的所有照片,也不得出于商业目的以照相,电子或任何其他方式复制修改照片。这是专业摄影师的标准条件。

2. 客户允许摄影师展示本次拍摄的作品,并允许这些作品用于推广工作室所用的社交媒体,网站,和示例相册等。工作室不得将客户的照片用于任何本工作室案例展示以外的任何商业用途。

3. 照片的电子文件所有权归摄影师所有,在这个条件下摄影师分享给客户的所有电子文件,客户可以用于自己私人的社交媒体,婚礼以及其他私人用途,并保护照片的版权。客户不得将照片用于任何商业用途,尤其是工作室的所属的相关行业。如有特殊要求,需与摄影师协商后达成双方一致认可。

 

第五条 不可抗力

在工作室控制之外的罕见情况下,如果出现拍摄当天完全照相失败,摄影师受伤或突发疾病导致无法拍摄,工作室的责任将仅限于所有已支付款项的全额退款。工作室有完整的专业第三方责任赔偿保险保护客户的财物。

 

第六条 取消预约

1. 当工作室因为控制之外的原因(生病,受伤甚至死亡等)不得不单方面取消预约时,工作室有责任退给客户全款并出于道义推荐其他摄影师给客户。

2. 仅预定拍摄的客户拥有拍摄15天前无条件退全款取消的权利。当客户在拍摄前14天以内8天以上取消预约,可以收到全款80%的退款。当客户在拍摄前7天以内3天以上取消预约,可以收到全款20%的退款。当客户在3天以内取消预约,没有退款。

3. 预定婚礼服务的客户需提前30天以上邮件联系工作室进行取消或者修改,30天以上取消可获得除注册项目外总款100%退款,15-29天取消可获得50%退款,7-14天取消可获得25%退款,当客户在7天以内取消则没有退款。

4. 冰岛婚姻注册项目属于特殊项目,一旦预约后由于客户的原因取消或者申请失败,工作室不予以退款。

 

第七条 改期

1. 当取消预约时双方可以协商改期,即在适应浮来工作室的时间安排的情况下安排新的预约。所有费用将挪到新的预约时间里,取消条款则根据原来的预约时间计算。若双方协商改期失败,则参照第六条安排退款。

2. 客户须在尾款中补齐工作室因改期已消费的费用(包括并不限于:住宿费,时效道具票费等),工作室须向客户出示已消费金额的证明。

 

第八条 因恶劣天气而改期

1. 当天气恶劣时,工作室需和客户双方达成新的共识,商量改期或改拍摄地点。

2. 工作室将尽最大的努力确保客户顺利完成拍摄,因此摄影师有权根据当天当时的天气等自然情况决定改变拍摄计划,在此拍摄计划特指拍摄的地点。如果客户坚持拒绝改变拍摄计划但天气等自然状况与此冲突时,拍摄计划不得不取消,没有退款。

 

第九条 退款

当工作室需要向客户退款时, 工作室因此订单已消费的费用(包括并不限于:住宿费,信用卡转账费等)将无法退还。工作室需向客户出示以消费金额的证明。

 

第十条 个人安全

当拍摄时摄影师给被拍对象的指示时都将视为此人有行为能力并会为自己的安全负责,这说明摄影师在拍摄时不应为他人的个人安全负责任,客户需在接到拍摄指示时应自行判断当时的情况安全与否。

 

第十一条 投诉程序

1. 客户可以在收到摄影师提交的作品一周以内与摄影师或工作室进行讨论修改,若收到作品后一周没有任何评价,作品将被默认为满意,客户将不能再提出任何意见。

2. 任何其他投诉需以电子邮件或电话的形式联系工作室,工作室将会在收到的5个工作日内予以回应。

 

隐私

客户所有的个人资料将仅用于工作室内部使用,工作室将不会泄露给第三方。如果客户希望自己的资料从工作室的数据库中消失,请书面联系工作室。

 

本条款修改于2023年9月,浮来工作室保留随时修改或修改其服务条款的权利,如有修改我们将会对合作伙伴和已预定的客户进行通知。 同时浮来工作室也保留对其条款和条件的解释的最终决定权。

Terms and Conditions about Iceland On Image as the photography service brand of Studio-fræ ehf. 

 

In the following terms & conditions “the photographer” shall mean photographer from Studio-fræ ehf. “The client(s)” shall be those persons defined in the booking form. “The company” shall mean Studio-fræ ehf. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the company in writing. By booking, you agree to the below terms and conditions.

 

1. Booking:

1.1. In order to reserve the appointment, a deposit is required at the time of booking in order to reserve and secure the appointment unless otherwise confirmed by the company, unless the company has right to cancel the booking and re-open the availability of the day.

 

2. Payments:

2.1. Balances owed for appointment must be paid before the session commences. Payment may be paid by cash, bank transfer, or online payment such as AliPay, PayPal. If the client(s) book through another platform, payment policy should follow the platform.

 

3. Prices:

3.1. Sales slip will show at the booking detail, and an invoice will be made by the studio. If there is any additional good or service like horse rental, boat rental, or make-up service provided by other people, the client should pay when the service happen. 

 

4. Display:

4.1. The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums, etc.

 

5. License, Coverage, and Reproduction:

5.1. Photographs taken during the course of the session/event will be at the discretion of the photographer although every effort will be made to comply with the client's requirements.

 

5.2. The photographer shall be granted the artistic license in relation to the poses photographed and the locations used. The client(s) should follow the photographer's instructions and the photographer’s judgment regarding these matters shall be deemed correct.

 

5.3. When attending events the photographer shall endeavor to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.

 

5.4. At certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the event may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

 

5.5. The photographer should not be held liable when the shooting activity cannot be completed successfully due to the customer's personal reasons.

 

5.6. On location or events due to a variety of uncontrolled lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs.

 

5.7. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

 

6. Prints, reprints, and enlargements.

6.1. The photographer offers a vast array of print and enlargements sizes all with different aspect ratio’s, some of the enlargements sizes cropping may/will occur. The client(s) may ask advice before ordering enlargements.

 

7. Products receiving:

7.1. The company will provide a link for a private folder from an online driver that contains all the pictures the photographer produced, the client(s) should transfer all the files in 30 days. The photographer and the company will not be responsible if the files disappeared after 30 days.

 

8. Creative License:

8.1. The company shall be granted the creative and artistic license in relation to the choice of locations and poses used. The company and the photographer's judgment on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes in the weather and the availability and willingness of subjects. The company will do the best to honor requested photos but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

 

9. Copyright:

9.1. The 1998 Copyright, Designs, and Patents Act assigns copyright to Studio-frae unless at the time of booking a release is negotiated. By purchasing images in either print or digitally you are purchasing the right to the image, not the copyright and therefore have no rights to reproduce the image in or on any medium. You may not copy the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for professional photographers. 

 

10. Ownership:

10.1. All digital negatives (computer files) remain the property of the photographer. On occasion, the photographer may supply a copy of the edited digital negatives to the client(s) for their own non-commercial use.

 

11. Force Major:

11.1. In the unlikely event of total photographic failure or injury beyond the company’s control, their liability shall be limited to a full refund of all monies paid. The client(s)'s statutory rights are not affected. The company has third-party liability Insurance.

 

12. Cancellation:

12.1. If the company has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. 

 

12.2. If the client cancels the appointment an unconditional refund policy exists up until 15 days prior to the reserved slot. If the client cancels the appointment in 14 days but before 8 days, 80% of the full payment refund will be granted. If the Client cancels the appointment in 7 days but before 3 days, 20% of the full payment refund will be granted. If the Client cancels the appointment in 3 days, no refund granted.

 

13. Postponement:

13.1. Should the canceled appointment turn out to be a postponement, then, subject to the company's availability, all monies paid may be applied to the new appointment. In the new appointment, if cancellation happens again, cancel terms should be considered by the original appointment date. If a new date cannot be agreed by both parties, the refund should be granted by following No.12.

 

14. Postponement Due To Adverse Weather:

14.1. If the appointment has to be canceled by Studio-frae-frae due to adverse weather conditions a new, mutually agreed appointment will be made. 

 

14.2. Photographer has rights to change the plan according to the natural condition such as the weather at the moment of photo shooting, in here plan means the places that session/event will be taken place. However, if the client(s) refuse to change the plan and insist to cancel the event, in this case, it will be non-refundable.

 

15. Personal Accident:

15.1. Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

 

16. Complaints Procedure:

16.1. Please address any complaints to Studio-frae by email or phone call. We will endeavor to respond to any complaint within 5 working days of receipt.

 

 

17. Privacy

17.1 The company have no access to the client(s)' credit card information if they did any payment through this website.

17.2. The company might store the client(s)' name and address details on a private internal database. Those details will not be made available to third parties as specified in this Privacy Policy statement. If the client(s) wishes to have their details removed from our database, please contact the company in writing.

These Terms and Conditions are in accordance with Icelandic law. Studio-fræ ehf. will keep the right of explanation and revising.
